It is mutually agreed that the following terms of agreementcontract form an integral part of your booking and that no variation of modification of these terms and conditions shall be effective unless accepted by R&A Photography in writing.

A deposit of R1000 (non-refundable) is required when the client signs this booking form. Dates are only reserved when the deposit is paid by cash or EFT. A full unconditional refund policy exists for a period of 14 days from the receipt of the contract and payment.

When you reserve your date with R&A Photography, we begin to decline other events for that date. For this reason, the following rules apply: (1) if the client postpones the event 14 days after the contract is completed; the deposit will be retained as a cancellation fee. (2) If the client postpones the event but wishes to retain the services of R&A Photography for a future date, the deposit will be retained for the future event which will be at the discretion of the cinematographer and provided that the cinematographer is available for the future date.

Payment of the balance of the cinematography fee is to be made no later than 14 days prior to the event. An invoice will be dispatched to you approximately 4 weeks prior to your event as a reminder.

Weather permitting; the wedding cinematography will be taken as agreed. In the event of rain, snow or any other form of weather disturbances, the cinematographer will do his best to produce coverage of the wedding within the time allocated to him.

The copyright of cinematography remains with R&A Photography. R&A Photography grants the clients permission to make copies of the images under the following conditions. The images taken by the cinematographer are for personal use by the clients, their friends and relatives. Sales, publication or any commercial use of the cinematography is not allowed without the written permission from the cinematographer. R&A Photography may use photographs cinematography for self-promotion on social media platforms only with explicit permission by the clients.

All images/cinematography are delivered as edited. R&A Photography usually delivers the digital files within 8 to 10 weeks from the event date. The client(s) allows the videographer/photographer to display any video, sound or image covered by this contract for promotional and demonstration purposes, including advertising, websites, social media, printed media, etc. RAW and unedited images/videos will not be given as part of the package as they do not form part of the contract cost.

Original raw footage (non-edited material) is the sole ownership of the videographer and is not intended for client viewing and is not part of the supplied finished package (see Force Majeure below). Original material might be offered to the customer if the videographer is unable to produce the edited program. All material will be kept for at least one year from the date of the wedding.

Video taken during the course of the event will be at the discretion of the videographer, although every effort will be made to comply with the client’s requirements. Whilst every effort will be made by the videographer to supply the client with a satisfactory product based upon the videographer’s advertised style, and to the specified requirements agreed beforehand, all editing and post production will be carried out to the videographer's discretion. The length of the video depends on the length of Client’s wedding, and the professional discretion of the editor. R&A Photography will provide music for the video unless provided by the couple.

Editing Discretion and Background Elements Client acknowledges that all editing and retouching decisions are made solely at the Photographer’s discretion. Unless the photoshoot is conducted in a controlled studio environment, the Photographer is not responsible for the removal of background elements such as vehicles, people, objects, or other environmental distractions that may appear in the final images. Additional editing requests, including but not limited to object removal, may be subject to additional fees and are not guaranteed.

In the event of the videographer being unable to attend the filming date due to illness, injury, etc. he/she will endeavour to provide or recommend the client with a suitable replacement videographer / editor. The videographer shall not be liable in the event of bad weather or unforeseen circumstances, including illness, from preventing him/her from completing the work. In the event of equipment failure beyond the videographer’s control, including theft of equipment or material, the videographer is not liable for refund or compensation, but will try to appease the client using any available recorded material. In the unlikely event of a total video failure, liability shall be limited to a refund of monies paid other than the deposits. The videographer reserves the right to cease filming or editing if situations arise that are unfit to continue, e.g. Grounds of safety, mistreatment, offensive or abusive behaviour, or unacceptable working condition. In these instances, the videographer is not liability for refund or compensation.

R&A Photography has full creative control over all aspects of every production/ film. Amendments will only be carried out if agreed by R&A Photography who reserve the right to refuse amendments to their films except for any mistakes in terms of spelling error on the part of R&A Photography. Revisions, amendments or any re-editing will incur an additional charge which will be invoiced to the client and must be paid in full before any amendments/ editing will be carried out.
